Terms and Conditions
These Terms and Conditions govern your use of Settli, a Swedish rental-housing marketplace where tenants and landlords can discover each other, communicate, and, where agreed, enter into rental contracts electronically.
1. About Settli
Settli is a Swedish rental-housing marketplace that helps tenants discover rental homes and helps landlords find potential tenants.
Through the Settli app, users may create tenant and/or landlord profiles, browse rental listings, indicate interest in properties or users, match with other users, communicate through in-app messaging and, where the parties agree, facilitate the electronic signing of a rental contract.
Settli provides the marketplace and technical infrastructure. Unless expressly stated otherwise, Settli is not a party to the rental agreement entered into between a landlord and a tenant.
2. Acceptance of these Terms
By creating an account, accessing or using Settli, you agree to these Terms and Conditions and agree to comply with applicable laws and regulations.
If you do not agree to these Terms, you must not create an account or use Settli.
These Terms apply together with our Privacy Policy, which explains how Settli collects, uses, stores and otherwise processes personal data.
3. Eligibility
Settli is intended for adults who are at least 18 years old and legally capable of entering into agreements relating to the use of the service and, where applicable, rental agreements.
By using Settli, you confirm that the information you provide is accurate and that you meet the applicable eligibility requirements.
You must not use Settli if doing so would violate applicable law or any restriction that applies to you.
4. Accounts
You must provide accurate, current and complete information when creating and maintaining your Settli account.
One Settli account may contain both a tenant profile and a landlord profile. You are responsible for ensuring that the information associated with each role is accurate and up to date.
Account security
You are responsible for maintaining reasonable control over your account and the devices you use to access Settli. Login verification codes must not be shared with other people.
If you believe that someone has accessed your account without permission, you should contact Settli promptly.
One person, one account
You must not create or operate accounts for other people without their authorisation, impersonate another person or deliberately provide misleading identity information.
5. Tenant and landlord roles
Settli supports two primary user roles: tenants and landlords. Depending on your circumstances, you may use one or both roles through the same account.
Tenant
A tenant may browse available rental listings, create a tenant profile, indicate interest in properties, match with landlords and communicate with matched users.
Landlord
A landlord may create and manage rental listings, review relevant tenant information, accept or decline potential matches and communicate with matched users.
Using a particular role does not give you any right to access information that is not made available to you through the Settli service or that you are not otherwise legally entitled to access.
6. Tenant responsibilities
If you use Settli as a tenant, you are responsible for ensuring that information in your tenant profile is truthful, relevant and not misleading.
You must:
- Provide accurate information about yourself.
- Keep relevant profile information reasonably up to date.
- Communicate honestly and respectfully with landlords and other users.
- Not misrepresent your identity, financial position or circumstances.
- Not use Settli to obtain access to properties or information for an unlawful purpose.
7. Landlord responsibilities
If you use Settli as a landlord, you are responsible for the accuracy and legality of the rental listings you publish.
You must:
- Only list properties that you are legally authorised to offer for rent.
- Provide accurate information about the property, rent, availability, amenities and applicable house rules.
- Keep listing information reasonably up to date.
- Communicate honestly with prospective tenants.
- Comply with applicable Swedish rental, housing, anti-discrimination and consumer-protection laws.
- Not use Settli to publish fraudulent, misleading or unlawful rental offers.
8. Listings and user content
Users may upload or submit content to Settli, including profile photographs, listing photographs, biographies, property information, messages and material submitted in reports.
Your responsibility for content
You are responsible for the content you submit and must ensure that you have the necessary rights and permissions to provide it to Settli.
Content must not be unlawful, fraudulent, defamatory, discriminatory, threatening, abusive or otherwise inappropriate.
Licence to operate the service
By submitting content to Settli, you grant Settli a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process and display that content to the extent reasonably necessary to operate, maintain, secure and improve the Settli service.
This licence ends when the content is deleted, except to the extent Settli is required or permitted to retain it under applicable law or as otherwise described in our Privacy Policy.
9. Matching and communication
Settli may allow tenants and landlords to indicate interest in one another or in rental listings. Where the relevant conditions are met, a match may be created.
A match does not guarantee that a rental agreement will be entered into, that a property is suitable, or that a user is trustworthy or legally entitled to offer or rent a property.
Chat functionality is provided to allow matched users to communicate. Users are responsible for the statements, representations and agreements they make in those conversations.
You should exercise appropriate caution when communicating with people you have not previously met.
10. Rental contracts and BankID
Where a tenant and landlord agree to proceed with a rental, Settli may provide functionality that allows the parties to execute a rental contract electronically through the app.
Electronic signing
Settli uses an electronic-signing provider together with BankID for the relevant signing process.
BankID is used to electronically identify the signing party and support the signing process. Information required for identity verification may therefore be processed as part of the signing process.
Responsibility for the rental agreement
The tenant and landlord are responsible for reviewing the rental agreement before signing it and for ensuring that its terms are accurate and legally appropriate.
Once a rental agreement has been validly signed, the parties are responsible for complying with that agreement and with applicable law.
11. Acceptable use
You must use Settli only for its intended purposes and in compliance with applicable law.
You must not:
- Use Settli for fraudulent, deceptive or unlawful activities.
- Create fake profiles or impersonate another person.
- Publish false, misleading or fraudulent rental listings.
- Harass, threaten, stalk, discriminate against or abuse another user.
- Attempt to obtain passwords, verification codes or other authentication information from another user.
- Upload malicious software, harmful code or content designed to disrupt the service.
- Scrape, systematically collect or otherwise misuse information made available through Settli.
- Circumvent security measures or attempt to gain unauthorised access to Settli systems.
- Use Settli to advertise unrelated products or services without our permission.
- Use another person's personal information without a lawful basis or appropriate permission.
12. Safety, reports and blocks
Settli provides reporting and blocking functionality to help users respond to suspected fraud, abuse, inappropriate behaviour or other safety concerns.
You should report suspicious listings, behaviour or communications through the available Settli reporting functionality where appropriate.
Settli may review reports and take action where we consider it necessary to protect users, the platform or third parties. This may include removing content, restricting functionality, suspending accounts or terminating accounts.
Settli does not guarantee that every fraudulent, unsafe or inappropriate activity will be detected or prevented.
13. Suspension and termination
You may stop using Settli and request deletion of your account at any time, subject to any applicable legal or contractual obligations.
Settli may suspend, restrict or terminate your access where we reasonably believe that you have violated these Terms, applicable law, or where action is reasonably necessary to protect users, Settli or third parties.
Examples of grounds for action
- Fraudulent or deceptive activity.
- Fake or misleading rental listings.
- Harassment, threats or abusive behaviour.
- Unauthorised access or attempts to compromise the service.
- Repeated violations of these Terms.
- Conduct that creates a significant safety or legal risk.
Where appropriate and legally permissible, Settli may provide notice before taking action. Immediate action may be taken where necessary to prevent harm, fraud, security incidents or other serious misuse.
Effect of termination
Termination of your Settli account does not automatically cancel or invalidate a rental agreement that you have already entered into with another party. Your rights and obligations under such an agreement are governed by that agreement and applicable law.
14. Service availability
We aim to keep Settli available and functioning reliably, but we do not guarantee that the service will always be available, uninterrupted or error-free.
Settli may occasionally be unavailable because of maintenance, updates, technical problems, third-party services, network failures or circumstances outside our reasonable control.
We may modify, suspend or discontinue parts of the service where reasonably necessary, subject to applicable law.
15. Liability
Settli provides a technology platform connecting tenants and landlords. We do not own, manage or inspect every property listed through the service and do not guarantee the conduct, identity, financial position or legal status of users.
To the extent permitted by applicable law, Settli is not responsible for losses arising from agreements, communications or interactions between users, including disputes concerning rental properties or rental contracts.
Nothing in these Terms excludes or limits liability to the extent that such exclusion or limitation is prohibited by applicable law.
Consumer rights
If you are a consumer, nothing in these Terms is intended to restrict any mandatory rights or protections that apply to you under applicable law.
16. User responsibility
You are responsible for your use of Settli and for complying with these Terms and applicable law.
If your unlawful conduct or material breach of these Terms causes a third party to bring a claim against Settli, you may be responsible for losses that Settli incurs to the extent permitted by applicable law.
This provision does not limit any mandatory consumer protection rights or otherwise impose liability where such liability cannot legally be imposed.
17. Privacy
Settli processes personal data in connection with your use of the service. The types of information collected, purposes of processing, legal bases, retention periods, third-party providers and your rights are described in our Privacy Policy.
The Privacy Policy forms an important part of the information governing your use of Settli and should be read together with these Terms.
18. Changes to these Terms
We may update these Terms from time to time to reflect changes to Settli, our services, applicable law or regulatory requirements.
When we make material changes, we will take reasonable steps to notify users where required by law.
The "Last updated" date at the top of these Terms indicates when the Terms were most recently revised.
Your continued use of Settli after updated Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
19. Governing law and disputes
These Terms are governed by the laws of Sweden, subject to any mandatory consumer-protection rules that may apply to you.
Any dispute arising out of or relating to these Terms or your use of Settli shall be handled by the competent courts in Sweden, subject to mandatory jurisdictional rules and applicable consumer rights.
Nothing in this section prevents a consumer from relying on mandatory rights concerning where legal proceedings may be brought.
